I live in Florida and in 1999 purchased a pure bred German Shepard from a well known breeder in the area. The contract guarantees the dog's hips and if in the case of hip dysplasia, breeder will replace the dog with dog of equivalent value. We have chosen a replacement , but breeder now refuses to replace the dog until after Xmas because of this being "his season to sell more dogs."
Is breeder legally allowed to decide when he will replace the dog ?? Contract only states guarantee is for a 10 year period.

If a contract such as yours does not specify a definite time for replacement, then the law assumes a “reasonable length of time.” What is reasonable depends on the circumstances in each case. A little over a month, given that the dealer has a good commercial reason to wait the month might very well be considered a reasonable amount of time. But there really is nothing you can do about it. It would take longer than the month to bring this to small claims court, so I suggest you just wait the month for the dog.
