we entered into a fee agreement with an attorney to handle a probate matter as well as co-counsel for litigation. we were told at our initial consultation we would have the services of both for the price of one. in other words, our attorney would have the benefit of consulting with the co-counsel litigator, at no additional cost to us. our attorney has forwarded us a balance due statement for his services and a separate bill from the litigator, addressed to our attorney, for his services– in essence a duplicate billing.

this becomes an even "stickier" issue now that we have just been advised by our attorney that at some time in the past this litigator, he has been working with all along, had left the co-counsel firm we entered into an agreement with and gone "solo".

are we financially responsible for this litigator's fees or is it our attorney's responsibility to pay the litigator out of the fees we have paid him? we would like your advice prior to responding to these statements. thank you.
