If a vehicle is left unattended at a auto-repair (mechanical) shop, after the mechanic has told the owner to pick the vehicle up, as he cannot work on it and then vehicle is broken into and damaged after the owner has not picked it up for several days, is the mechanic/shop owner responsible for damages?

My response:

Where was the vehicle parked; e.g., on mechanic's property ?

Was the vehicle behind a locked fence ?

Was the mechanic being paid for storing the vehicle ?

Is there a "disclaimer" on the work order ?

Was the work order signed by the customer ?
