Hit by a DUI driver

I found out that a person driving a City tractor (mower), working for a city had a DUI just a month prior to hitting my van and injuring my wife and daughter. Was any rules or laws broken by him doing this? I know that most states do not require a drivers license, but this guy was driving a tractor/ pulling a bushog for a city and he hit my car and injured my wife seriously and banged my wife up pretty bad. This person should not of been able to drive a tricycle moeless a heavy piece of equipment on a busy highway, for a city. Legal advice/ rules and regulations/ etc requested. I know we all have opinions, but i need facts in this.
