Can someone be considered an Implied partner.

I am in a very bad situation I was refered to as a partner in a business for quite sometime.I also tried to get this partnership in writing by having a lawyer create papers for a partnership.The owner refused to sign them.Yet the company did pay the lawyer for his time even though this owner failed to use the papers.

I never had any signatory rights on company checks,was never on a tax return,was never by name on anything,my name appeared on no autos,no insurance papers.and I was given a 1099 at year ends for my earnings.Which listed me as a sales manager.

If any one has any info that may be helpfull I thank you.My state is NEW YORK .
