in colorado, if someone gives you medicine because you are sick at work and sends you home, you get pulled over by the policeand ticketed for d.w.a.i.,and you find out later that your friend spiked your medicine to help you sleep, can you be convicted? what happends to your friend? help!

good luck getting jurry to believe that one. but if you can prove, by statements of witnesses or suspect(s) you have a case. what did the person slip you? and how do you know that they did. it would be a crime for that person to slip you some kind of medicine without telling you(in most states.)

If the drug given to you was an "over the counter" medication you cannot be charged with a drug offense of any major degree. If it was a prescription drug for another person,and you took it,you violated the Scheduleing Laws of the FDC. This is a potential felony.
as for the spiking of the medication,you'd have to get the "spiker" to admit he did this to you as the "spikee",thusly volunteering for a criminal charge and jail time. Good luck doing that!!!
