we live in illinois. my question is, can schools legally random test students for drug and/or alcohol use,because they suspect, without the parents permission? if the student refuses,can they legally take action, such as a suspension,expulsion, detention etc.?

Get a copy of your school's student handbook. All the rules will be laid out there.

There are certain legal limitations on who can be drug tested and what the potential penalties are, and I'm guessing that your school will be within those limitations.

The best place to start, though, is to check out your school's handbook -- and make sure it's following its own rules, at the very least.

If it's not following its own rules, then you have a potential cause of action.

If it is following its own rules, then the next step is to see if the rules themselves violate the law.
