2 party check cashed with only 1 signature

Florida. I had a Money Market CD with my partner. He received the check and cashed it in his own account without my signature. He won't give me the money. Would this be considered bank fraud? Even though it was my money to start with, can I at least sue him for half the funds?

If the check was made out to Jones AND Smith then the bank should not have cashed it. If it was to Jones OR Smith then the bank could deposit it in his account. How was the original CD set up? Yes, then you can sue him for your share. You will need documentation showing origination of the funds and that 1/2 belonged to you.
