I live in South Carolina and on our Church Finance Committee. Our Pastor has requested that his contributions be taken out of his pay before taxes. Is this legal? Who pays the tax? It seems to me he is cheating the government and his congregation. Need advice to protect the church from any fines or charges of tax fraud or etc. Your advice is greatly needed and appreciated.

It would not be legal to do as he asks. If there is withholding on the minister's wages, the full amount of withholding must be made, based on his total salary, then he can claim a deduction for the contribution.
