I am sorry this is going to be so long...
My DH & I are looking to buy a restaurant in Iowa. The problem is...
The person we are buying from signed a contract agreeing to the purchase price and stating that all equipment in the building is included in the purchase price as long as it is done within the next 30 days. Now he is taking stuff out of the restaurant and stating that it wasn't on the equipment list that he gave us. He is putting price tags on everything that wasn't on the equipment list and saying that if we don't want it, he will need about a week to get everything out of there.
My questions are...
1. If he takes anything out of the building, is that a Breach of Contract?
2. What are our options if he does? Can we sue him? Take him to small claims?
Thanks in advance for all your help!
Susie
