Divorce agreement specifically states that NCP will claim one child and CP the other child. For the last two years, CP has claimed both and we expect to get audited.

CP has stated that she doesn't agree with the divorce agreement and wants to get it changed.

We know she will have penalities, fines, etc. for her illegal actions but what are the chances that she will get the agreement changed? NCP pays over 12, 800 annually in CS and is not in arrears.

WE KNOW SHE WILL HAVE PENALTIES, FINES, ETC. FOR HER ILLEGAL ACTIONS

If NCP does not claim the child that NCP is entitled to, the IRS will probably never question CP about this. If they do question the deduction and NCP agrees to sign a Form 8332 to release the exemption to CP, there will be no problem. If NCP will not sign a Form 8332, the NCP would be entitled to the exemption.

WHAT ARE THE CHANCES THAT SHE WILL GET THE AGREEMENT CHANGED? NCP PAYS OVER 12, 800 ANNUALLY IN CS AND IS NOT IN ARREARS.

Without knowing all the circumstances, it is not possible to give a comprehensive answer to this, but from what you say, unless there are some other important reasons for the change, the chances are slight that the agreement would be changed.
