My 17 y.o. daughter in Illinois was charged in July with a February delivery charge of 10-30 gm of marijuana. Allegedly to an undercover drug task force agent. In April she was in a home, temporarily staying there as a live in babysitter, when that house was raided and drug paraphanalia was found but no drugs. She had $300 on her that was confiscated but she was not charged with any crimes. She got the money back several weeks later after giving the drug team some names of other people she knew were involved in drugs. After that incident she left the area and no longer associated with those people. The drug task force went to her new residence (out of their jurisdiction) stating that they had evidence against her and that they would not press charges if she wore a wire into a home they suspected of drug dealing. She feared going into this home and would not cooperate with their request. She was polite about it and explained her fears. Several weeks after that, in July, she learned about the delivery charges (a February date) by reading about them in the local paper. She was never served any papers. She adamantly denies ever handling the marijuana. She states her boyfriend at the time (also charged with delivery) did all the dealing and wouldn't let her have the key to his locked box. She lived with him on and off for about one year. He never had a drivers license so she had to transport him every where. After he got his license at age 19 he "dumped her." We knew he would when he didn't need her any more. This occurred before she knew about the charges filed against her. She was turning her life around and talking about college this Fall when all these legal issues started.
My concern is her future with a Felony conviction. The State's Attorney says the trasaction was taped. Do we have the right to hear that tape? She can not remember ever doing any transactions. What defense can she possibily have? How long can they continue to bring up other charges if she plea bargains out of this one? She can't afford an attorney so she has a public defender. How well can she expect to be represented?
