in minnesota a person was intoxicated, asleep in their truck, stuck in snow approximately 100 yards from the road, and the truck would not start due to a failed starter.
the drinking occured at the spot where the driver and truck was found according to the driver. is this cause for dismissal of the charges?

With a good lawyer, yes. With out a good lawyer,the driver was technically in control of the vehicle,and then the law also allows for "reasonable doubt" as to how or when the driver and vehicle got to the place in which they were found.
Odds are....if you fight it,you'll win,but the expense of fighting it will excede the costs of the fines. Then again,you'll have a clean driving record.......you have to weight this one out on your own. Cost-vs-consequences.
