I know I am, but I'm still deciding weather to take the case to small claims. If I win, I'm afraid I still won't get the $$ and wondering the success rate of garnishing wages

There are costs involved, just as there are when filing your small claims suit. Whether you want to go to this expense is something you will need to consider carefully because, one, there is no guarantee of winning ANY legal action and, two, a judgment as I said earlier is the easy part. Collecting on a judgment can be hard.

I personally would try the certified letter first, advising the mom that you are seriously considering taking her to court if she does not pay. Then do your serious considering.

You can consult with an attorney in your area if you wish but this is likely to cost you more than the $100.
