being sued for 10 year old debtWhat is the name of your state?What is the name of your state? Kansas Ugh!!! If this is a repeated post, I apologize. I just don't think the first one went through. So.... here I go again.... I live in Connecticut. My husband is being sued by the state of Kansas Department of Social and Rehabilitation Services. We received an "Out of State Summons" dated December 13, 2005 and a "Petition for Reimbursement" filed on December 12, 2005. His ex-wife received cash assistance (welfare) during their seperation, prior to the divorce. They have one child. He was in the Navy in Florida at the time. He sent her money and items but cannot prove this, as it was 10+ years ago. She "received $878.00, for the time period of May 1995 through November 1995 for the support and maintenance of said minor child." This is the first time we've heard of this debt, ever. They are willing to settle for $750.00 if we can pay it by January 13, 2006. I researched the articles sited in the petition and found that article 39-718a states "When more than one person is legally obligated to support the child, liability to the agency or subdivision shall be joint and several." I suspect that the SOL could be found in K.S.A. Chapter 60, but I was unable to find it. QUESTIONS: 1. What is the SOL on this type of debt? (Is the state exempt from SOL?) 2. Can they really do this or are we being bullied? 3. Isn't the ex-wife equally responsible for the minor child therefor equally liable for this debt? Last edited by IdunnoY; 01-10-2006 at 01:30 AM. |

| usually money owed to the state or government does not go away...you are probably better off just to pay it |

| Yep, Zephyr is correct, no SOL for government debts, they can go after their money by any legal means necessary until they get it.
