I live in Virginia.

I am being sued by a former friend who added a line to his cell phone plan for me to use several months ago. When he defaulted on his part, the phones were disconnected at which time I secured a cell phone through a different company.

I was never actually on his contract but now he is stating that I am liable for the charges that posted after the phones were turned back on, even though I didn't use it after it was disconnected.

Am I liable even though I never signed a contract and paid my part before the phones were turned off? How do I prove I did or does he have the burden of proof?
