You can sue him locally but it will be impossible to enforce the judgement. You'll need to sue him in his home state.

I'm confused, why do you not avail yourself of the Ebay/Paypal (and even potentially your credit card if you backed the paypal with that) redress before going to the incredible effort to sue.

You're recovery by the way will not be more than the $800 paid.

Because winning "fair and square" isn't the standard. This is what you were out, not what you envisioned you were getting. Yes you can ask for the filing fees and other costs of bringing the case to be added to the judgment, they will be added at the discretion of the judge.

It seems like you already think you know the answer, so good luck winning what you think you are entitled to get.

I agree with FlyingRon that you will only get what you paid plus the filing fee. The court is not going to order him to turn the remaining items over to you nor will it accept your estimate of what you think they are really worth. Your travel expenses will also not be awarded.

Your best best is to file with ebay/paypal to get your money back. Anything else will lead to additional expenses and aggrevation.
