A neighbor across the road claims that our landscaper ran over a small bush in her driveway while he was backing out of our driveway. The landscaper denies this. The neighbor did not see him run over the bush nor did anyone else-she just assumes he did it. Often cars and trucks use our driveway and our neighbor"s after making a wrong turn. The neighbor demands that we pay for the bush ($65.00) or will take us to small claims court. For us, it's not about the money-it's that she's shaking us down and it sets a bad precedent for anything else that she might decide we should pay for in the future. The neighbor has no proof and refuses to be reasonable. When/if she takes us to small claims court, we'd like to counter this by sending her a letter to sue her for harrassment in civil court. Can we do this? If so, should it come from an attorney or can we write the letter? :mad:

Why bother? Unless she can prove the landscaper did the deed, she has no case.

In fact, she has no case against you at all. Tell her to sue the landscaper and leave you out of it.

What do you mean by harassing you ?

We do not know the Landscape of your or her properties , or If the Landscapers truck left tire marks , or what .

If you mean she comes on your property and/or calls constantly , Verbally tell her to stop then send her a letter telling her any further communication should be in writing , but before doing that have you asked her what proof she has ?

Also this is not a police matter , but SC Court .

Sc's is an informal forum , deciding on what is more likely that not , with the testimonies and/or evidence of the case .

Also , was the Landscaper licensed and insured ? They should be named as the Defendant anyways .
