What is the name of your state (only U.S. law)?
Whether you can sue an insurance company depends on far more facts than what you have provided. What is the name of your state and what is the nature of the claim you believe you have against the insurance company?

And is it your insurance company or somebody else's?
The prompt here is that insurance companies only have duties to those they insure. If it's your insurer whose misbehaving, you sue them. If it's someone else's, you sue the person who caused your damage and the insurance company must respond.
