Contractor will not refund deposit

We provided a contractor with a deposit for 50% of anticipated work with the understanding that if we did not get approval for work, we could not proceed with the project. Shortly prior to commencement of the work, we received notification that we could not undertake the project. Contractor agreed to refund $. One month later, contrator refunded deposit less an amount for certain fees. After a dispute with the contractor regarding these "fees", contractor cancelled our deposit check (which we believe to be unlawful). We are willing to pay the disputed fees, but contractor will not reimburse the amount previously provided and subsequently cancelled. We are not willing to write-off the substantial deposit. We are considering using the small claims process. Any thoughts on the matter are appreciated.

Suggest that you contact the NC Contractors licensing board and see if they will mediate for you.
