You ask when you are speaking to the judge, or when you write out a statement detailing the facts of the case as you know it, why you should prevail, and what you would like the judge to do.

Sometimes you can, sometimes you can't.

But generally a judge cannot/will not do anything for you that you do not request. It never hurts to ask!
