I signed a two year contract with a local gym who closed a few months later. They automatically transferred memberships to a gym 6 miles away but a long drive in lots of traffic. The new facility is NOT comparable - they do not offer the same amenities as the previous gym. The contract states it must be comparable. I have tried calling, writing letters, contacting BBB but nothing. I have since stopped automatic payments on my credit card. Can I take this to small claims, suing for the amount it will take to pay off my contract along with extra service fees from my declining credit card?

Simple answer, no. Small claims court is for actual monetary losses, you have not suffered any losses at this time. It would take a higher court to rule on the validity of the contract and whether the gym is in compliance.
