My ex-boyfriend of 7 months gave my children dirtbikes
(2 total) for christmas (the gift was totally his idea). We all went including my kids to the dealer to pick out and purchase. The titles are in his name and mine. His attorney also states that he wants the jewlery back that he gave to me for christmas. All of the above gifts were wrapped and given to on christmas. We have been broke up now for @ 2mths and he didn't want anything until i filed a "no contact" order with the police after several incidents of "stalkish behavior". He had an attorney email these such requests and said he will be with police escort to pick up , being he is not allowed any contact with me. What happens if I refuse to give back? Do I let his attorney know that I'm refusing? Will he win them back if he takes me to court?
The jewlery I don't care about, I'll return to him, but my children would be heartbroken if he took their bikes back. He's the one who got them soo pumped up and took them to every trip with him when he was going from place to place to check them out before buying them.
I would greatly appriciate any advise on this matter.

I am intitled to have to return items that are CLEARLY gifts?

My response:

As for the bikes, no. Once a gift is given, the original owner is no longer the owner. The bikes are your children's property.

As for the jewelry, you never mention what kind it, or they, were; e.g., a necklace, a watch, a diamond ring, etc. Were there any gift cards that came with the jewelry? If so, do you still have those cards, or anything else making reference to the jewelry?

Was there any talk of marriage?

there weren't any gift cards, but the necklace came in a picture frame that i still have, and i have pictures of me opening the gifts on christmas. he mentioned that he wanted to marry me but i'm not even divorced, im legally seperated. in fact just 3 weeks prior to christmas, we split up and then got back together @ 1 1/2 weeks before christmas, because of him being soo persistant in wanting to work it out. i'm most concerned about my childrens gifts. and do i reply to his attorney stating what i'm going to give back and what i'm not? how do i state it, do i need to give reasoning?

The jewlery I don't care about

Then give the jewelry back and retain the bikes for your kids.

My response:

Thank you. Now, get the attorney's letter and, leaving out actual names, I want you to write EXACTLY what the attorney wrote to you.
