My ex girlfriend is sueing me for $7500 (max in Colorado). She traded in a car and could not get the financing on the new one in her name so I put my name on the loan. The car she traded in could barely run. She made all the payments. We broke up and I got the car back. I told her I would give her any money made off the car but I didn't make any money off of it. I made all of the insurance payments on the car. In my mind she payed for use of the car. The only thing I think I might owe her is the money from the trade in of her car. I had to the hit on the depreciation of the new car (about $6000). Please any help would be great. Thanks

Who's name was on the title? Did she agree that you sell it and give her any profits? Can you show proof you made nothing?

Your post implies that this was HER car. So, why EXACTLY did you get the car.... and under what premise???

I told her I would give her any money made off the car but I didn't make any money off of it.
More confusion.... How do you 'make money' on a car that isn't yours?? Did you in fact sell it?? If so, how long after you took it?? How much did you sell it for??
How did you sell it if it was titled in her name??
See, LOTS of missing information here that is essential in trying to figure this out.

I made all of the insurance payments on the car. In my mind she payed for use of the car.
It really doesn't matter what is in your 'mind'.... what were the EXACT terms of the agreement??

Bottom line.... no one can accurately answer your questions without knowing ALL the facts.

My name was the only name on the loan. The car was never titled in her name. She did not have the credit to get the loan in her name. Yes, she did agree that I sell the car and give her what ever I made off of it. Yes I can prove that I made nothing on the car, I even had to make up $6000 to payoff the loan. We never had a written agreement that she would make the payments. She was getting all the use out of the car and made the payments. The bill came to me but she would pay it every month. The insurance bills came to me as well and I just paid them. Let me know if anything else is missing. Thanks everyone

Okay. With that.... it is YOUR car to do with as you please.... including selling it.

Absent some document to the contrary, I don't see where she has any right to expect ANYTHING from the sale. Simply, it was your car... and you have the right to sell it.

Then you shouldn't have any problem.

Though she MIGHT have some obscure claim for something from the car, I really don't see where it would stand.
You didn't 'make' anything on the sale.
It was YOUR car.
She would have NO claim to anything.
Her claim of making payments does not alter the fact the car was YOURS.

If you sold the car and didn't make any money on it , why did you have to make up $6,000.00 on the loan ?

Was that a Junker too ?

The car was nice, I was just that upside down on the loan.
Just one more question, Even if she can prove that she made payments will I still have no problems. Thanks everyone.

No one can answer whether you will or not, because we have no idea what claims, if any, she might make supported by her payments.

She will deny or have another story for every single thing you have said on this thread in your favor.

Plus, she'll have some other goodies thought up too.

(Don't ask me what she will do or how it will turn out...if I knew the answers to questions like that, I would not be posting on this forum but instead would be hitting the casinos in Vegas....)
