What is the name of your state? Tx. I bought a car from my aunt about 4 years ago. I paid her the amount agreed upon. I have some of the money order receipts for the money I sent her, but not all. She never sent me the title. Last week I was hit by another car and my car was totaled. Since the title isn't in my name will the other guy's insurance make the check out to me or her? If to her, what can I do?

They will make the check out to the OWNER of the vehicle.

If to her, what can I do?
You can ask the insurance company to make payment in BOTH names, but they have no obligation to do so.
Or you can ask your aunt to endorse the check and give it to you.
Or you can sue your aunt if she refuses and takes the money. Of course, you would have to PROVE ownership if she says that you never paid, etc.
