Our third roommate moved out yesterday, breaking her lease that we all signed, which is thru Sept 30, 2007. She is still living in this state but in a different county (4 hours away). Do we file our court matter in the county we live, or the county she now lives in? And if we have to file in the county she now lives in, can we sue for mileage/gas costs for the trip there and back, in addition to unpaid rent and utilities?
Also, she did not take all of her things, and says that she is coming to get them sometime next month. This is the second time we've had a roommate break their lease with us, but last time, we didn't know where he moved, and didn't sue him. We did have the locks changed after the 3rd, because the landlord said if he didn't pay by the third, they would consider the lease abandoned by him, and would change the locks. If we do that this time, do we have to let our former roommate get her stuff before the court hearing, or can we wait until after?
