In Texas if I'm being sued in a small claims court and she states she is suing me for a vehicle and not money, can the J.P. judge in her favor even though he says it must go to a higher court? Isn't out of his jurisdiction if he knows the suit is over personal property and not money? Should the case have been dismissed and have her file through the proper means?
