In Small Claims Court does the Judge have the right to call the defendant when he fails to appear for a scheduled hearing.
This was the second time the defendant failed to appear.
After we WON the first time the defendant(who happens to be an Attorney) claimed he didn't know he had to be in court that he thought the case had been dismissed.
The Judge then reversed his decision and we went back the second time. The Judge heard the defendant and refused to dismiss the case.
Today we were in court again and again the defendant failed to appear at the assigned time. The Judge then had his assistant call the defendant (the Attorney) while we sat and waited 45 minutes for him to finally arrive.
Is it common for a Judge to call a defendant.
To me it looks like the Judge is giving aid to the defendant (Attorney).
Would the Judge have given us the same break if we forgot to appear.
Is there anyone to whom we can complain.
It seems as though the Attorney is getting special treatment from the Judge.
Help Please!

I don't know about small claims, but in other Court proceedings , it not uncommon.
