Legal fee's be recovered via small claims court?

Good afternoon:

I was curious if a person claimed copyright on some seemingly royalty free graphics on a website, you asked for proof of copyright, and it resulted in them having to pay a lawyer to write a letter saying that they had a app "on file" (not actually registered) with the US Copyright office.... can the plantiff sue for recovery of funds for having to supply that letter to you?
