Loss of wages for having to go to court?

Ex wife is taking husband to court over co-payments made from Jan-05 thru Mar-05. She typed a list of appointments and the co-pay amounts and sent to us mid Apr-05. Since then she has sent her typed statements about 4 times and the amount changes each time. She has sent statements from Dr. showing that payments were made on date of service and explanation of benifits from her insurance. She has never sent any receipts showing she paid any of the co-pays within 30 days of billing us and she told us that she paid cash for the co-pays at the time of the appointment.

We sent her a check for the co-pay for the 1 office visit that was within the 30 days from the time she billed us (last appointment in March was within 30 days of submitting bill). Which she has not cashed and is over 90 days old.

We have explained to her that she didn't bill within 30 days of paying the co-pay and she never sent any receipts to prove otherwise so she can not expect for us to pay. In March when they went to court the judge told them both that they couldn't hord bills & they had 30 days to submit a bill and 30 days to pay.

If she takes this to small claims court (she's threatening she will) and she looses can we ask for loss of wages to attend court that day?
