I went to small claims court today for mediation. I thought I saw a tape recorder in the other parties belongings. Can they record what was said during mediation? And if so can they use it against me during trial?

Sure they can !

Is it proper and lawful to do ?

Hell, no !

Can they use it without your permission ?

Absolutely not !

Sorry, but Texas is a 'one party state'.

Only one person needs to know of the recording and the contents of the tape can be revealed and used.
