What is the name of your state? Kentucky
My question is this: Can a person bring more than one case against another person for the same time period but for different reasons.
Here is the scenario: In KY the small claims limit is $1500.00
We had a tenant that owes use of $1500.00 in back rent before she was evicted and had done over $1500.00 in damages to the unit after the deduction of security deposit.
Can I take this person to court two separate and distinct times?

From the surface why not. One claim is for back rent, and the other claim is for
damages. Though they are related to one another, they are still distinct and different.
Food for thought: Small Claims on one; and garnishment on the other.

For your convenience, I have gathered links for you to review about KY & Small Claims & Tenants.

This statement is not true. Both actions would be a result failure to comply with a single document, the rental or lease agreement.

It will really depend on how smart the person you are suing is. The defendant could ask for the cases to be joined and then have the cases dismissed because as a whole they would exceed the state limit for small claims court. Or have both moved to a higher court.

Duh me! Thank you kind Sir, yes, both actions stemming from failure to comply...
