I represent a natiaonal non-profit company registered in the states of California and New York. We recently ran a petition on a free website: petiononline.com

We got a lot of defamatary and abusive commnets posted by one or two individuals. We want to know who they are and have requested the company for their IP addresses. The company said they will release it if we give a subpoena.

How do we get a subpoena?

You may need to file a lawsuit against "Jon Does 1 & 2" and then subpoena the web site for the poster info to find their names. This will require a lawyer.

Have your lawyers look at how the RIAA is suing people who share music even though they don't know their names initially. pay attention to the setbacks that they has with their initial subpoenas.

The key here is that you shouldn't file a lawsuit to get their names unless you think you can win the lawsuit. Otherwise you may be hit with a countersuit.
