I filed a special civil complaint against the home seller and real estate agency who sold me my house. The main part of the complaint dealt with misrepresentating the status of a finished basement in terms of being up to code with township rules.
In any case, neither of them filed an answer to the complaint within the required time. I'm currently waiting for a date to make my case to the court and expect to be awarded a positive judgment in my favor.
I'm trying to figure out why neither party would file an answer to the complaint. One opinion from a friend of mine was that they will just wait and appeal the judgment, there by saving attrny costs and their time. Is this common?
NJ law states answers for corporations need to be filed by an attorney, does this mean they HAVE to file answers, or if decide to file, it just needs to be done by an attorney?
