What is the name of your state? michigan.

are you allowed to sue a vacation company using a small claims court even if the company is based out of a state besides your own?
the problem is minivacations promised my wife and a certain free vacation with a $100 deposit and nothing else. We filled out the form and sent it in last October 2002 for the month we wanted with was March 2003. The company replied and said the dates are full. The next available date that the company suggested that we take was July 2003. We accepted. In late April, early June the company called us back and told us that the dates they selected for us in July 2003 were FULL again. We were tired and requested our $100 deposit back which the company said would take 4-6 weeks to receive. Have not received it yet and we have called numerous times about it and they continued to reassure us that the money will be sent outas soon as it is processed. The companies name is mini vacations. WHAT SHOULD WE DO!!!!?????

You can file a small claims action against them... but need to do it in the state where they are located.... or where they have a presence. For example, if this business is located in Ohio , but has a vacation facility in Michigan, you can sue them in Michigan. File in the county court where their 'presence' is located.
