What is the name of your state? N.J. i BELIEVE I AM BEING CHARGED MORE THAN THE LAW ALLOWS FOR A FORCLOSURE SUIT IF I READ CORRECTLY THE NJ LAW ALLOWS 3.5% OF THE FIRST 5000.00 AND 1.5% OF THE SECOND 5000.00 AND 1% OF THE REMAINING AMOUNT OVER 10,000.00 HERE IS THE SITUATION THE SUIT INCLUDES A 2ND AND A 3RD MORTGAGE SAYING THEY ARE 30 DAYS BEHIND THIS IS NOT TRUE THE 2ND AND THE 3RD MORTGAGES ARE PAID UP TO DATE. THE TOTAL FOR THE BOTH MORTGAGES ARE 53,350.00 NOW THE PRIMARY MORTGAGE IS 110,000.00 THE FEES IM BEING CHARGED ARE 2500.00 BY MY CALCULATIONS USEING THE METHOOD ABOVE THE FEE SHOULD BE 1,917.00 GIVE OR TAKE A FEW DOLLARS. SO MY QUESTIONS ARE AS FOLLOWS IN N.J. IS THE FORMULA I DESCRIBED CORRECT AND THE ONLY LEGAL LIMIT THAT THE MORTGAGE CO CAN COLLECT? NEXT IF THE PRIMARY MORTGAGE IS THE ONLY ONE IN DEFAULT SHOULD THE FEE BE CALCULATED MINUS THE 2ND AND 3RD MORTGAGES? MEANING ONLY THE PRIMARY MORTGAGE AMOUNT SHOULD BE CALCULATED FOR THE FEE AMOUNT. IF YES TO THE ABOVE CAN I SUE THEM IN SMALL CLAIMS COURT FOR THE EXCESS FEES THAT I PAID TO HAVE THE ACCOUNT REINSTATED.

Hi Sorry for the caps. I don't type very good. and thought caps were easier. I have read some cases on the net that say the fees in new jersey are limited. the figures I mentioned in my post were from one case I saw. I wanted to know if that was the limit that could be charged in my state.
