Im remodeling my condo and decided to go with a business that advertised on Craigslist for kitchen cabinets. He had a professional looking website and his work looked very good.
We met 2 weeks before Thanksgiving, he gave me a typed receipt that outlined the order and I gave him a down payment of $450.
The first week of December I contacted him and he said that they would be "done in 2 more days" (I sent this through email so I have proof ).
He has given me the run around on 3 more occasions and he continues to advertise his business on Craigslist. I looked for him on BBB and he is a legitimate business.
My question is, if I take him to court what is the extent I can sue for? Just a refund or
actual damages:
1. Place that can do my order is going to charge me a $300 rush fee to do the work,
2. Place wants $250 more to do the work than he quoted me
3. Loss of rent (roomate) income, I can prove that I have missed out on at least a months worth of rent.
4. Anything else possibly?
Would this be considered "breach of contract" or is his reciept not considered a contract?
Im trying my best to handle this with him but I cannot wait much longer..
