My new wife and I obtained a loan to refinance her car which paid off her previous loan which was a joint loan with her previous boyfriend. Unfortunately the pay off amount was wrong and we overpaid by $411. The refund check for the overpayment went to her former boyfriend's address and he kept the money. We sent a certified letter to him explaining what had happened and asking to give back the money.

Questions

Does the money belong to us (my wife and I)?

Would small claims court look favorably on us?
