pay check bounced and refused

What is hi i am ayen,my pay check was bounce three time,two check paid and the last check was refused by the employer, because i left them.
i am in out of status in US
1,can i file a case against them in the small claim court ,if i file will there be any problem for me .
2,now i am in california and my employer is in virginia( i worked for them in virginia),can i file a case in california against them.

You would have to file in Virginia. Another route would be to turn the bad check over to the police.
