Problem with a witness, notarized testimony?

What is the name of your state? Colorado

One of my witness's is asking me if I mind if he does not come to court as something came up and he needs to go out of town.

Can I have him submit a notarized testimony? Will it count for anything?

I don't really want to force him to come as he is the contractor I am going to use to install my new kitchen floor.

This guy heard the kitchen cabinet contractor that I am suing say "I made a mistake, I should not have done this in the evening, I see the dried stian drip marks and the steel wool...I will fix all of it".

As you can see, this witness is kind of "valuable".

first try and see if you can get the hearing continued.

the notarized statement is worthless. You need him in court testifying in person so he can be questioned by the other side and/or the judge.
