I live in Texas. My question is if I am not served or notified of a small claims suit against me, can the suit still proceed? Will the JP still hear the case without the defendant not being served or notified at all? Thanks For any help.

How do you know about the suit if you were not served or notified? Procedurally, you need to be served.

I guess a more realistic situation is that I am not served and even a long time after the trial was finished, I do not know the existence of its judgement. Then, suddenly I received a summons to return to the courthouse. Under this circumstances, what can I do to protect myself?
