Question about DFACS case

I live in the state of GA and have since I returned from a term of military service in november of 2009. I became involved with a woman and her adopted son, renting a room for 300 dollars a month with a legitimate rental agreement. Her son is troubled, his mother was a prostitute and he takes several kinds of medication. one day when he was particularly acting out, holes in the wall, cursing at his mother, i raised my voice demanding he behave, cursing as well. That was the end of it until he caught me kissing his mother. He reported he had missed the bus because he was disturbed by the yelling, coached by an ex friend and family lawyer of his mother. As for the yelling, DFACS determined this was emotional abuse. I have been out of the house since living there for anywhere from a weekend to a week at a time at the house while the child is visiting his birth mother who just got out of prison waiting for DFACS to come up with a family preservation plan.

I stayed there two weeks ago. The woman who adopted the troubled child was brought to court where she was told that Ive been court ordered never to set foot on her property again, though IVE never been involved in the court or served any papers. Was told by the judge she would have to box up my belongings and bring them to me, that they were abandoned belongings anyway even though DFACS had agreed I could store them there, and ive stayed in the house several times since then.

Ive a two part question. What if anything can I do about this DFACS nonsense, and what specifications must property meet to be considered abandoned? Ive been told I cant even go with a police escort, even though NO CRIMINAL CHARGES HAVE EVER BEEN FILED, and I have nothing but a single DUI on my record, and a DIP that was nolle pros.

Should I have posted elsewhere? I thought small claims would be suitable due to the question about what specifications property must meet to be considered abandoned. The Dfacs question is not actually a family law question as I, having been served no papers, wanted to know whether I could retrieve my belongings. No TPO is in effect or been applied for. I'd like to know before it really DOES become abandoned property.

No criminal charges were ever filed for some reason HOWEVER MOM was told that you were not allowed to be around IF SHE wanted to keep her son. Basically, she was given a choice. As for the property, mom can bring it to you.

I have furniture and things that she simply can not move by herself, a big screen TV among them. Surely there is a way to go with police escort and pick up my belongings. Abandoned property question? And there HAS to be a viable way to fight and reverse this DFACS descision. I mean I haven't even seen the kid in over a year, and if my father got kicked out because he yelled at me I would have been in foster care. This entire affair is ridiculous.
By the way? No criminal charges were ever filed FOR SOME REASON because no criminal act was committed. I yelled at a badly misbehaving child, who then used his dubious origins and relationship with a dfacs lawyer to manipulate the situation to his benifit. DFACS tried for a TPO and the judge THREW IT OUT.

You are not the child's father. Move on. An honorable man would never make a woman choose between him and her child.
