Recoup Attorney Fees

I was threatened with a private condemnation suit
by an attorney representing a third party client.
As such I contacted and hired an attorney. I was
assured that I would be reimbursed for attorney
fees assuming judgement was in my favor (which
I was not in doubt as I have an exclusive easement
with four other adjoining property owners).
After three months and much correspondence and
$1350 attorney costs, the adverse attorney stated
that private condemnation was not necessary as
his client had title to access. This is incorrect and
now I am told by my attorney that I cannot recoup
attorney costs. I am wondering if I collect attorney
fees I paid as a result of hiring an attorney after
threat of suit and should I file claim against the
attorney that threatened me with a lawsuit or
his client or both?
