What is the name of your state?

I am from Texas and recently a friend of mine was dating a guy who used her credit card to sign up for many pornography sites online. His total bill came out to be over $500 in a single month and at this time she found out about it and kicked him out of the apartment that she was living at. They had only been together for about a month at most but at that time he had brought into her apartment many of his items such as a tv and computer. When she kicked him out she decided to hold his computer as a safe gaurd to make sure he paid her back the money he spent on those websites. Now, almost a year later he has not called back until about 4 months ago saying that she better give him the computer back or else he'll take legal action. Now the computer is still just sitting there unused and she is wondering if he does have a case against her or if not when would she legally be allowed to sell the computer to recover her money back. The computer itself is pretty old so it won't amount to more than $400.

Yes he can and he'll win most likely. She had no right to hold his computer for ransom.

What she SHOULD have done is file suit against him for recovery of the monies owed.

Tell her to give him 10 days to come get his crap then get on with her life ...

What she should do is sell the computer for $400 and consider it a $100 loss. Does she have anything else of his to sell? If she does, tell her to sell it. I've been ripped of for about $3400 in the past two years (car accident which wasn't my fault/ motor work/robbed)
She won't get her money, but you know what? Neither will he.
