Georgia is where this happened.

My husband had a collection lawyer sue him for an unpaid account.
1.16.08: Plaintiff/Attorney filed claim
1.22.08: Husbands mom served, court rec'd sheriff's entry
1.28.08: We paid the requested settlement amount
2.05.08: Check was deposited by Attny (we have a copy of the deposited check)
4.09.08: Default filed by Attny
4.14.08: Default Judgment for Attny

6.25.10: We are married now and trying to get approved for a loan, lender says there is a Judgment on husband's credit report that we have to have settled

6.28.10: Get copy of credit report, look up case #, see that all of this has happened and we were unaware that the court proceedings took place after we mailed the settlement check

Email Plantiff/Attny and ask for a settlement letter, letter is received a week later.

2.25.10: Pull husband's credit report notice that Judgment is still on credit report, look up case # notice that court has no record of Settlement

What can we do? Not only did we pay the settlement BEFORE a default was filed but the court still has no record of the settlement by the Plaintiff.

Please help. We can't get approved for a loan until this is cleared. What is the name of your state (only U.S. law)?
