What is the name of your state? nevada I am being sued for their late payments on a house that i previously owned and sold before any late payment occurred. And i did not sell the house to the person that is suing me. They owned the house at the time regular payments were due. AND There is no contract between us. I have proof of who i sold the house to . And proof of who they sold it to. Which is who is suing me. Is it "malicious prosecution" or "abuse of process" can i sue for ? waisting my time, stress, ect. i can show that they are lying. i sold the house to a guy on"july 2,2004" and had it recorded "july7,2004" he then sold the house to the new owner on"july13,2004" and had it recorded"july21,2004" the new owner is claiming i owe him for july and aug 2004 when he decided not to make the payments. i know i have the case beat. besides the fact the owner is crazy. can i countersue for fraud or ?
