My son was in an auto accident that was not his fault. We would like to make a claim in Small Claims Court, but are not sure who we would need to sue. Would it be the family of the girl who hit his car or their insurance company? Her insurance company paid to fix her car but denied my son's claim. We don't think her family could afford to pay anything even if we won the case.

you would sue the driver of the other car and the registered owner of the other car. If you win the case, the other party's insurance company will pay the award.

Also, you need to be aware that the defendant(s) will very likely have attorneys provided for them by their insuarnce carrier.
