What is the name of your state? NY/CA

I'm just out of college (2 more weeks!) and am being un-rightfully sued at the moment over a stupid matter that should be dismissed. My court case was supposed to be tonight be he, in his many antics, found a way to adjourn it until June 30. Now, as I apply for jobs and company's run Background Checks before hiring me, does this lawsuit surface? Could it be a deciding factor in an employment decision?

Most backround checks look at your criminal history, being sued is a civil matter and will not show up.
