What is the name of your state? Ca

I am suing a former employee who stole $250 from my cash register. I am also working with the police, but they said that the amount is small and getting their bandwidth is difficult. I have video (3 camera angles) of her taking the money.

Do I need to send her a letter demanding the money, or just serve her with the court docs? She is moving around a lot and finding her twice could be difficult, especially with the element of surprise gone.

My response:

California Small Claims rules of court require that a "demand for payment" be first made - - "if possible". Only you can determine it's "possibility" and, if not, explain the same to the judge why having not done so was "futile."
