What is the name of your state?NY

Is it illegal to record a phone conversation with another party that do not want to go to court that has information about the defendant, and that information is the defendant's admission to the wrongdoing that would be evidence used in small claims court to find the defendant in fault. Also can that same information or conversation be used in criminal court to find the defendant guilty. Thank You
